What is Uber and Lyft's Insurance Policy Model?

While your damages may be high, Uber and Lyft provide significant liability coverage in the event that their drivers cause an accident. As mentioned previously, you must file a claim with the driver’s insurance company before you can file a claim with Uber or Lyft.

Uber and Lyft share similar insurance models. If you do file your claim with a Rideshare company, you can receive the following amounts of coverage depending on the stage of the Uber or Lyft ride at the time of the accident.

Period 0: The driver was not on the Uber or Lyft app at the time of the accident. You receive no coverage under the company’s policy.
Period 1: The driver had the app open but did not accept a ride yet. You receive up to $25,000 in property damage liability, $50,000 in bodily injury liability per person, and $100,000 in bodily injury liability per accident.
Period 2: The driver was on the way to pick up a passenger. You receive up to $1 million in liability coverage.
Period 3: The driver had a passenger in the vehicle. You receive up to $1 million in liability coverage.

How Can You Collect Compensation After a Rideshare Accident?

If you are the victim of a rideshare accident in Grand Junction, you have two legal pathways available to you: you can file an insurance claim, or you can file a lawsuit. There are many routes you can take inside of these pathways.

For insurance claims, you can file a claim with the at-fault driver’s private insurance or Uber or Lyft’s insurance. Uber and Lyft require you to file a claim with the at-fault driver’s insurance first, and if the company denies your claim or your damages exceed the policy limits, you can file a claim with Uber or Lyft.

How about Lawsuits against Uber or Lyft?

In terms of lawsuits, Uber and Lyft consider their drivers independent contractors. This essentially releases the companies from liability in situations where their drivers cause accidents, and you cannot file lawsuits against them directly in most cases. However, if your insurance claims do not succeed or your damages exceed the insurance limits, you may file a personal injury lawsuit against the at-fault driver in civil court.
